BULLETIN #5 - Lack of Due Diligence On The Penultimate Work Plan
 


The Chiefs of Ontario maintains its position opposing the Nault Governance Initiative in accordance with Resolutions 02/01 and 01/40.

  1. The Work Plan was developed by senior INAC officials with the participation and support of officials from the office of the BC Vice Chief. AFN officials have been excluded from the negotiation process. All information on the negotiation process is second hand, through the Vice Chief’s office.

  2. Work Plan drafts have usually been presented to the AFN Executive on a confidential basis, shortly before Executive meetings. Technical analysis has been discouraged.

  3. On one occasion, senior AFN staff suggested a series of amendments to the Work Plan more in line with a Rights Based Agenda. This technical input was criticized by the BC Vice Chief.

  4. The AFN and the BC Region have not subjected the Work Plan to any kind of independent legal or technical analysis. Essentially, First Nations are being asked to endorse the material on a hope and a prayer.

  5. The Chiefs of Ontario asked respected legal counsel Nahwegahbow, Nadjiwon, Corbiere to review the Work Plan. The unedited legal opinion has been made available to all First Nations. David Nahwegahbow concluded that the Work Plan has fundamental flaws.
